Worcester firm fined for asbestos violation
The Massachusetts Department of Environmental Protection (MassDEP) has penalized Modern Manufacturing Inc. of Worcester $16,137.50 for allegedly failing to follow proper asbestos removal procedures while renovating a residential high-rise building.
According to MassDEP, inspectors found window caulking and glazing containing asbestos being improperly removed at the Southbridge Street building during an inspection in October.
MassDEP said in a statement that Modern Manufacturing was conducting a window replacement project at the site and failed to notify the department in advance.The company also failed to remove, handle and store the materials properly, according to MassDEP.
State regulations require materials containing asbestos to be removed wet before demolition and renovation work begins, with wet asbestos waste sealed in leak-tight containers marked with warning labels, MassDEP said. These procedures are meant to prevent asbestos fibers from being released into the environment.
“Companies conducting renovation project must first determine if any asbestos-containing materials will be involved,” said Lee Dillard Adams, director of MassDEP’s regional office in Worcester. “Asbestos is a known carcinogen and following prescribed regulatory work practices is imperative to protect workers as well as the general public.”
Richard Uras, owner of Modern Manufacturing, said his company was told that the site had been inspected for asbestos and was found to be clean within the previous two years, and a visual inspection of the building did not indicate the presence of asbestos. Uras said mistakes happen on occasion in the industry, and that his company immediately complied with MassDEP’s regulations when the asbestos was found.
Under the terms of a negotiated settlement, MassDEP said Modern Manufacturing will pay $10,000, while the remaining balance will be suspended, provided the company does not have repeat violations for one year.
