Massachusetts Department of Environmental Protection has penalized Lancaster lumber treatment facility and distributor Bestway of New England, Inc. $9,620 for hazardous waste and toxic use violations.
Bestway neglected to register its waste oil activity and meet waste oil management requirements, according to MassDEP. The company failed to mark and sign a waste oil accumulation area, properly label waste oil containers with their contents, and post emergency response information.
Inspectors discovered Bestway did not complete a written plan addressing its toxic chemical usage, after certifying it had. Moreover, the general manager signed the submitted plan’s summary as a certified planner despite the fact he was not, according to MassDEP.
“Failure to properly manage hazardous waste and to plan for reducing the amount of toxics used at a facility puts the environment, the public and employees at undue risk of exposure,” said Mary Jude Pisley, director of MassDEP’s Central Regional Office in Worcester, in a press release.
Bestway has since corrected the hazardous waste violations and has plans to address the toxic use violations within the timeline of a consent order.
