For the second time in less than three months, Ayer-based food manufacturer Nasoya Foods USA, LLC has been fined by the Massachusetts Department of Environmental Protection, the state organization announced Friday.
MassDEP is fining Nasoya $5,000 for multiple noxious odor events in 2021, marking MassDEP’s sixth penalty letter to Nasoya for air pollution, per the release.
In 2017, Nasoya was issued a $27,360 penalty for odor violations, and the company made improvements to the air pollution control system at its tofu manufacturing plant at 1 New England Way in Ayer. However, the facility continued to emit off-site odors, resulting in more MassDEP fines totaling $30,000.
In March, MassDEP announced a nearly $20,000 penalty against Nasoya for violating hazardous waste regulations.
“Despite Nasoya’s attempts to control off-site odors, the company has repeatedly failed to operate its facility without creating nuisance odors for the community,” Mary Jude Pigsley, director of MassDEP’s central regional office in Worcester said in a press release announcing the fine. “MassDEP is requiring the company to take further actions in order to operate without creating a condition of air pollution.”
