One of three lawsuits Devens-based AMSC has filed against its former Chinese customer has been thrown out of court in China, a move AMSC has vowed to appeal.
AMSC is seeking $1.2 billion through lawsuits in China related to alleged breaches of contract and theft of intellectual property by Chinese wind turbine company Sinovel Wind Group Co.
In the second half of 2011, AMSC lost nearly all of its revenue from Sinovel after the company refused to pay for products it ordered.
The first, and smallest, of the three lawsuits in China against Sinovel was being tried in Hainan Province. AMSC alleges that its software is being infringed by Guoton Electric Co., one of Sinovel's suppliers, and is seeking a cease and desist order and $200,000.
Sinovel filed a motion for the case to be dismissed and tried in another court in Beijing. The Chinese court granted Sinovel's motion and dismissed the case, AMSC learned Friday.
AMSC vowed to appeal the ruling and continue seeking damages in all three cases.
