A New Jersey construction firm will pay more than $158,000 in back wages to resolve labor violations for 50 employees who worked on the 145 Front St. apartment project in Worcester.
The company, P & B Partitions Inc., will also pay a $33,880 civil penalty.
The company worked on the $90-million, 365-unit project as a drywall subcontractor between August 2016 and April 2018.
The November complaint filed by the U.S. Department of Labor alleged 50 employees who worked as laborers, dry wall hangers and carpenters were not properly compensated for working more than 40 hours a week and didn’t receive overtime pay.
“All such employees were paid straight time for overtime hours worked in cash,” said the complaint, which was filed in federal court.
According to the complaint, one laborer worked for 52 hours one week, but was only paid for 40 payroll hours and 12 hours of straight time pay in cash. A framer who worked for 44 hours during a week was paid for only 36 hours on the books and eight hours in cash.
The workers also alleged that the company failed to maintain records of cash payments, failed to accurately track hours and falsified payroll records.
The 145 Front St. apartments opened for leasing last February.
