The Massachusetts Department of Environmental Protection has penalized Sterling contractor Christopher McNamara a total of $69,860 for violating asbestos removal regulations.
The asbestos violations, which occurred at the Sterling Municipal Light Department maintenance garage, consisted of improper storage of asbestos waste in an open waste bin and failure to notify MassDEP of asbestos removal work, as required by law, according to the MassMEP press release announcing the penalty.
“As a general contractor, Mr. McNamara should be very familiar with the need to conduct a survey for asbestos-containing materials before beginning work, and of the need to ensure that those materials are properly removed and handled by licensed personnel in accordance with the regulations,” said Mary Jude Pigsley, director of MassDEP’s central regional office in Worcester, in the press release. “Asbestos is a known carcinogen, and by failing to follow required work practices, the company put workers and the public at risk, resulting in significant penalties, as well as escalated cleanup, decontamination and monitoring costs.”
MassDEP ordered McNamara, doing business under C & C Builders LLC., to pay $17,465 of the fine with the remaining $52,395 suspended for one year if no further violations are recorded.
