Boston Scientific settles spinal cord patent dispute for $85M

Marlborough-based Boston Scientific Corp. will pay California medical device manufacturer Nevro Corp. $85 million to settle all intellectual property litigation between the two companies. 

The dispute is over spinal cord stimulation patents. As part of the settlement, Nevro will grant Boston Scientific a license to use the disputed technologies worldwide and agrees not to sue Boston Scientific over the features in those paresthesia-free therapy technologies. In exchange, Boston Scientific will grant Nevro a license to use technologies under Boston Scientific’s patents and agrees to not sue over any features in any current Nevro product, according to a Monday press release from Nevro.

The patent disputes between the companies date back to a 2016 complaint related to Boston Scientific’s plans to release results of a high-frequency spinal cord stimulation study in 2017.

In November, Nevro announced that it would pay Boston Scientific $20 million after a Delaware jury found it had infringed on two of the Marlborough company’s patents. The settlement announced Monday results in a net payment of $85 million from Boston Scientific to Nevro.
