Worcester Lawyer Pleads Not Guilty To Fraud Charge

A Worcester-based attorney is facing charges of fraudulently collecting an estimated $120,000 in workers' compensation survivor benefits, according to the state Attorney General.

Herman Bayless of Brookfield was charged today in Suffolk Superior Court with workers' compensation insurance fraud and larceny of more than $250. He pleaded not guilty and is due back in court Aug. 19.

According to the attorney general's office, Bayless legally began collecting benefits in 2001 after his first wife-a corrections officer-died. However, by law, Bayless could not collect if he remarried. An investigation in 2007 by the attorney general's office revealed that Bayless had remarried in July 2004 but failed to notify the Department of Correction.

Bayless maintains his own law practice, which includes workers' compensation law among its areas of expertise, according to the attorney general's office.

A Suffolk County Grand Jury indicted Bayless May 22.
