James Taylor of Westboro was sentenced to two years and six months in prison for health care fraud offenses in which Taylor and companies under his ownership defrauded Medicare and Blue Cross/Blue Shield of Massachusetts $915,649 from 1993 to 2003.
The offenses stem from orders for respiratory home care equipment that was never delivered or worth more than what was actually delivered. Taylor and his three companies entered a guilty plea at a hearing in September. Vejay Oxygen Inc., West Suburban Medical Rental Inc., and Westborough Home Health Inc. all pleaded guilty to a three-count Information charging them with knowingly and willfully committing health care fraud.
U.S. District Judge Patti B. Saris accepted as final the guilty plea of Vejay Oxygen, which is no longer in business. The company did not have sufficient assets to pay the total fine, of which Taylor owes $636,088 in restitution. A previous payment of an additional $279,560 in related civil settlement was credited towards the full restitution amount. Following the two year, six month sentence, Taylor will face a $6,000 fine and two years of supervised release.
The sentencing of West Suburban Medical Rental Inc. and Westborough Home Health Inc., owned by Taylor and family members, was postponed. The case was prosecuted by Assistant U.S. District Attorney Thomas Kanwit.
