Wayland-based laser maker Candela Corp. has asked the U.S. Patent and Trademark Office to re-examine patents held by Palomar Medical Technologies Inc. in the companies' ongoing infringement battle.
Palomar, which is based in Burlington, sued Candela in 2006 claiming Candela had infringed upon certain laser hair removal patents held by Palomar. The lawsuit is currently stayed.
Candela claims the patents it is accused of infringing upon are invalid and says the re-examination could prove as much. The company also said the stay and the re-examination would result in "a precipitous drop in our legal expenses while we work to restore profitability to the company."
The company reported a net loss of $4 million for the first quarter of its 2009 fiscal year compared to net income of nearly $200,000 for the same period the previous year.
Candela and Palomar make lasers and other products used in cosmetic procedures such as hair removal and tattoo removal.
