An Upton contractor has been assessed a $40,150 penalty by the Massachusetts Department of Environmental Protection for violating state asbestos regulations when he demolished a residential property he owned in Franklin.
MassDEP announced in a release Thursday the contractor, Nathan Odell, arranged for demolition of a residence and barn at his property on Lincoln Street without having a licensed asbestos contractor remove all the asbestos-containing material from the structures.
The investigation reportedly found a licensed inspector identified the materials but Odell moved ahead with demolition as well as disposed of the debris at a transfer station not permitted by MassDEP to accept asbestos-containing waste material.
He also failed to notify MassDEP of the removal work, according to the release, as is required by law.
