Probation For Guidant

A Minnesota judge added a probation sentence on top of $296 million in fines and fees that Boston Scientific Corp.'s Guidant unit had already agreed to pay for hiding defects in defibrillators.

U.S. District Judge Donovan Frank had previously rejected a plea agreement in which Boston Scientific offered to plead guilty to two misdemeanors and pay the $296 million. According to wire reports, on Wednesday, Frank agreed to the deal with the addition of three years' probation for the company.

Guidant was accused of misreporting, or failing to report, problems that may have prevented its defibrillators from functioning. Prosecutors said the company may have known about the issue as early as 2002, but failed to report it for three years.

Boston Scientific acquired Guidant in 2006.
