Cambridge Street Price Chopper property sold for $16 million
Price Chopper, which operates 10 stores in Central Mass., has been hit with a federal class-action lawsuit accusing the grocer of misclassifying workers to avoid paying overtime compensation.
The suit, filed in U.S. District Court in Massachusetts, alleges that the company, based in Schenectady, N.Y., reduces labor costs by classifying its department "team leaders" or "managers" as being exempt from overtime protections, requiring them to work more than 40 hours a week without paying them the overtime premium that the law requires.
According to the complaint, a named plaintiff, Shelly J. Davine, was employed as a department team leader and department manager in three stores in North Adams, Lenox and Lee from 1983 until last month. Davine is accusing the chain of having her and others with similar job titles work alongside overtime-eligible employees, performing the same work but without overtime.
