Northborough aerogel insulation manufacturer Aspen Aerogels has won an initial determinations in a U.S. International Trade Commission investigation into two Asian companies infringing on its patents.
In the initial determination, Administrative Law Judge MaryJoan McNamara found Aspen has proven China-based Guangdog Alison High-Tech Co. and South Korean-based Nano Tech Co. have infringed on an aerogel insulation patent held by the company.
Guangdog and Nano have claimed Aspen's patent claims are invalid, but McNamara ruled the two Asian companies haven't proven that.
A full determination is expected from the U.S. International Trade Commission by Jan. 29.
Aspen Aerogels filed a complaint with the commission in May 2016 alleging the two companies imported insulation materials into the United States infringing upon a patent held by the company for the materials and methods for manufacturing insulation.
