Millbury company Midstate Sewerage will pay up to $500,000 in fines and will not seek state or municipal contracts as part of a settlement over illegal dumping, Massachusetts Attorney General Maura Healey’s office announced on Friday.
The company is accused of illegally dumping septage into the Millbury’s sewer system to avoid paying fees to the Upper Blackstone Water Pollution Abatement District, according to the AG’s office. The company lied to MassDOT about its disposal practices in order to be paid under a state contract to transport and dispose waste for the agency, the AG’s office said.
Additionally, Midstate is accused of installing an unauthorized septage storage tank at its Millbury facility and illegally handling and disposing waste oil after failing to register with the Massachusetts Department of Environmental Protection, according to the AG’s office.
“With the unauthorized pumping of waste into the local sewer system, the company intentionally avoided thousands of dollars in costs to transport and treat the waste at the Upper Blackstone treatment facility, and the significant penalty imposed today by the court emphasizes the severity of the violations uncovered by our investigation,” MassDEP Commissioner Martin Suuberg said in a statement.
Midstate is set to pay $500,000 in penalties and fees, with $150,000 of that figure suspended for two years pending compliance with the consent judgment.
