A 60-year-old Milford producer of lubricating oils for musical instruments is suing an Indiana competitor for patent infringement.
That infringement, Milford-based Al Cass, Inc. alleges, came after American Way Marketing (AWM) executives visited the Milford office on several occasions, including expressing an interest in purchasing the small company.
That offer, and another in a 2018 letter, were denied, according to a lawsuit filed in federal court.
In addition to marketing products using similar wording -- Fast -- and packaging, AWM allegedly made posts on the company’s website and Facebook page indicating that Al Cass products were unavailable.
Those postings said AWM’s products were virtually identical to Al Cass products.
According to Al Cass’s lawsuit alleging infringement, unfair competition and false advertising, the company has suffered a decrease in gross sales since the acts began. Al Cass is demanding the company change its packaging and pay damages via a jury trial.
The company is named after its founder, Al Cass, who developed the oil in conjunction with jazz musician Dizzy Gillespie.
American Way Marketing could not immediately be reached for comment.
