Consigli Construction of Milford and BP Third Avenue LLC, a subsidiary of Boston Properties Partnership, have been sued by an Acushnet-based plumbing and heating company over allegations of a lack of payment.
The lawsuit, filed in Middlesex County Superior Court on Monday, alleges Consigli owes the plaintiff, Acushnet-based Araujo Bros. Plumbing and Heating, hundreds of thousands of dollars for subcontract work done on a project related to a BP-owned property in Waltham that Arajuo worked on in 2021.
The company is seeking $624,570, plus interest, cost, and attorneys’ fees. Araujo claims the final contract value was $5 million. The company says in the lawsuit it billed Consigli $4.64 million, but the company has paid Araujo $4.41 million.
The lawsuit requests the judge place a lien on the property, 180 Third Ave. in Waltham, so the property can be sold to cover the costs allegedly owed to Araujo.
Calls to Consigli’s media relations department from WBJ went unanswered, and the organization’s voice mailbox was full. An email to Boston Properties Partnership was not immediately returned.
