Massachusetts Superior Court has granted Marlborough medical device maker Hologic a preliminary injunction against a Chinese X-ray company and a former employee for alleged theft of trade secrets.
Hologic, a medical imaging device giant based in Marlborough, alleges that Direct Digital Imaging Technology (DDIT) of Beijing and former Hologic employee Lawrence Ibbetson misappropriated trade secrets for technology used in mammography systems.
The company announced the court's decision in a Wednesday press release.
Hologic filed suit in 2016, alleging breach of contract for failure to pay for general radiography panels treated with the company’s proprietary coatings. In 2018, Hologic amended the complaint to include the trade secret claims.
As part of the preliminary injunction, the court ordered DDIT and Ibbetson to stop using or disclosing selenium coating specifications Hologic alleges were wrongfully misappropriated.
In addition, the court ruled DDIT can’t develop its own selenium coating unless certain conditions are met, including the product development be supervised by an independent monitor.
The injunction will be effective until the trial is concluded
