Jury Orders BSX To Pay $250M In Patent Case

Natick-based medical device maker Boston Scientific Corp. said it has been ordered to pay $250 million in damages related to a patent infringement case involving Minnesota-based Medtronic.

Medtronic accused Boston Scientific of infringing upon four patents for balloon catheters and coronary stent delivery systems. Boston Scientific claimed non-infringement among other defenses, but U.S. District Court in Marshall, Texas found that the equipment in question did violate Medtronic’s patent protection.

Boston Scientific said it will take an opportunity to defend itself again July 31. If the defenses are successful, the jury’s verdict could be set aside, the company said. If unsuccessful, Boston Scientific will seek to overturn the jury verdict at district court and possibly take the case to the U.S. Court of Appeals in Washington, D.C.
