Natick-based Boston Scientific says it will appeal a U.S. District Court judge’s decision to require the company to pay $324 million in damages to Johnson & Johnson as ordered in 2000.
After a jury awarded Johnson & Johnson $324 million in damages from Boston Scientific in a patent dispute over the NIR heart stent in 2000, Boston Scientific filed a motion for a new trial. Monday, the court denied Boston Scientific’s motion for a new trial and granted Johnson & Johnson’s motion for final judgment.
Boston Scientific said it expects the final judgment to be filed Sept. 30, but will appeal the decision. Boston Scientific no longer sells the NIR stent.
