Two senior-living condominium complexes and a child care facility abutting the site of an Intel manufacturing facility at 75 Reed Road in Hudson have filed a lawsuit in Massachusetts Land Court to halt plans to construct a proposed 1.2-million-square-foot distribution warehouse on the property.
Portman Industrial, the logistics real estate division of Atlanta’s Portman Holdings, proposed the project in July, which includes the distribution warehouse facility with 190 loading bays, 447 employee parking spaces, and 540 trailer parking spaces. The project is expected to generate 1,466 daily vehicle trips and 770 truck trips daily, according to a traffic impact study presented at an Aug. 30 Hudson Planning Board meeting.
The plaintiffs, according to the complaint filed with Massachusetts Land Court, are Quail Run Condominium Trust, a 150-unit residential community for people 55 and over, Westridge Condominium Trust, a 136-unit residential community for people 55 and over, and Hudson Children's Center, which offers programs for children kindergarten-age and younger.
In the complaint, filed on Oct. 19, the plaintiffs argue they would be adversely affected by the development; that the development, as a distribution facility, would not conform with the site’s industrial/manufacturing zoning designation; and because the project is being built on speculation, making it unclear what the site’s use and final user will be.
Judge Howard Speicher has been assigned to the case, according to a notice of judge and track assignment. The presumptive deadline for a trial would be in early 2024.
