Hudson concrete company sues for $500K over unpaid work at Heywood Hospital

S &F Concrete Contractors, a corporation based in Hudson, is suing Consigli Construction of Milford, Waterstone Properties of Needham, Heywood Green Street of Needham, and Heywood Memorial Hospital in Gardner for over $500,000 as part of requested enforcement of a mechanic’s lien for work performed by the company at Heywood Hospital.

The lawsuit, filed in Worcester County Superior Court on Friday, claims that the company has not received full payment for work done on Heywood’s new surgical pavilion. The lawsuit says that work was suspended at the site in July by Consigli after Waterstone and Heywood failed to pay for services rendered, and that Consigli terminated the contract with Waterstone and Heywood in September.

S&F claim that they are still owed over $500,000 for the materials and work they provided as part of the project.

S&F is seeking $529,797 plus interests, costs and attorney’s fees. The company seeks to have the court authorize them to foreclose on the property in order to satisfy the amounts due to them.

Massachusetts law allows for mechanic’s liens to be placed on buildings and structures by builders, contractors and subcontractors in order to secure payment for work performed on the property, according to the state’s trial court law library website.

Waterstone and Heywood Memorial Hospital did not respond to requests for comment.
