Framingham clinic operators ordered to pay $13.5M for deceptive marketing

Attorney General Maura Healey

Operators of an unlicensed Framingham clinic that marketed medications and services for erectile dysfunction have been ordered to pay $13.5 million, the Attorney General's Office announced Friday.

Kevin Hornsby, a licensed medical doctor, was ordered to pay $11 million in civil penalties and his wife, Heidi Hornsby, was ordered to pay $2.5 million, after a Suffolk Superior Court judgment went against them. The judgment also prohibits the couple from operating unlicensed medical clinics in Massachusetts or deceptively marketing any medication or medical service relating to the treatment of erectile dysfunction in the state, the state said.

The latest ruling follows one last August in which the clinic itself -- operating under the names Massachusetts Men’s Medical Clinic, Massachusetts Men’s Medical and Men’s Medical Clinic -- was ordered to pay $17 million. Of that, $6.3 million was for restitution.

More than 4,000 customers went to the clinic, according to the Attorney General's Office.

The Hornsbys allegedly used various deceptive practices in widespread TV, print and radio advertising to market the erectile dysfunction services and treatments sold at the Framingham facility. The Attorney General's Office filed a complaint in Suffolk Superior Court in July 2015 related to the allegations.

The practice has ceased operations, and the Horsnbys have filed for bankruptcy, according to the Attorney General's Office.
