Drug Company Agrees To Pay $2.4M To Bay State

The Massachusetts Attorney General has reached a $2.4 million settlement with a California-based pharmaceutical company.

Watson Pharmaceuticals settled a lawsuit brought by the AG's office that alleged Watson and its subsidiaries, Watson Laboratories and Watson Pharma, had reported false and inflated drug prices, which in turn inflated costs for Medicaid recipients in the state.

Watson was one of a group of 13 generic drug manufacturers that was included in the suit, originally filed in 2003.

Massachusetts uses national pricing reports to determine how much to pay pharmacies for various ingredients in prescription drugs. The false and inflated prices reported by Watson and others skewed the reports that the state relies on, according to the attorney general's office.

The generic drugs involved in the settlement were sold between 1995 and 2003. They were: carisoprodol, hydrocodone with acetaminophen, ibuprofen, labetalol, lorazapam, methylphenidate, Necon and trazodone.

Watson admitted no wrong-doing in the settlement and asserted that its price reports met legal requirements.

The AG's office previously settled with seven other defendants, including: Dey Inc.; Barr Laboratories, Inc.; Duramed Pharmaceuticals, Inc.; Ethex Corp.; Roxane Laboratories Inc.; Teva Pharmaceuticals USA Inc. and Ivax Corp. In total the companies have agreed to pay $14.275 million.
