Court Affirms Cybex Case, Reduces Judgment
Medway exercise equipment maker Cybex International announced that an appellate court has reduced a product liability judgment against the company by about 31 percent to $44 million, but affirmed the verdict against the company.
The case involves a New York woman who was paralyzed when a weight machine fell on her. Last year, a jury awarded her $66 million.
The company continues to maintain it was not at fault in the case and says that even the reduced judgment is too high.
Cybex said it will ask the New York State Court of Appeals to consider another appeal. It said it expects the court to decide whether to do so within 60 days, and, if it accepts the case, to consider it in 2012.
The company is analyzing the effect of the judgment on its fourth-quarter and full-year results.
