BSX Reportedly Loses Bid For Gene Therapy Rights

A California company announced it has won patent rights to key methods for the application of cardiovascular gene therapy in Europe, which Natick-based Boston Scientific was also vying for.

The decision was made by the European Patent Office, according to a statement by San Diego-based Cardium Therapeutics, the patent winner. Cardium is employing the methods in its Generx gene therapy to treat coronary heart disease, which is in late-stage trials in Europe, according to the company.

Boston Scientific had applied for the same rights, according to Cardium, resulting in opposition proceedings in Europe and interference proceedings in the United States.

A Boston Scientific spokesman was unable to confirm Cardium’s patent announcement Friday morning.
