BSX 'Disappointed' By Suit

Natick-based Boston Scientific Corp. says it's "disappointed" by a new civil lawsuit filed by the U.S. Department of Justice relating to defective defibrillators.

The False Claims Act complaint comes on the heels of a plea agreement reached over a criminal complaint on the same subject.

Both legal actions concern actions by Guidant LLC between 2002 and 2005, before it was acquired by Boston Scientific. In the new suit, the government alleges that Guidant made false claims to the Medicare program over the implantation of about 2,000 defective devices. It says 13 deaths may be attributable to the defects.

BSX said in its statement that the ultimate resolution of the lawsuit should not have a significant financial impact on the company.
