A U.S. federal court has ruled a California medical device company’s heart valve system infringes on a similar device from Marlborough-based Boston Scientific.
Boston Scientific on Tuesday announced the court’s decision, which found the company’s patent valid and that Edwards Lifesciences Sapien 3 Aortic Valve infringes on that patent.
The court said Edwards owes Boston Scientific $35 million for damages incurred through the end of 2016. Additional damages and interest incurred between 2017 and 2018 will be determined in post-trial motions.
Boston Scientific said its Lotus aortic valve system was found to not infringe upon three Edwards patents.
In a response, Edwards said it does not expect to pay the jury award because the U.S. Patent and Trademark office earlier this year determined all claims of Boston Scientific’s patent were invalid.
The company said it plans to appeal the ruling Boston Scientific did not infringe on Edwards’ patents.
The two companies are now involved in multiple patent disputes in several areas, including in several European courts and patent offices.
Boston Scientific said its Lotus system should be on the European market in early 2019 and in the U.S. by the middle of next year.
