Emptoris, a Burlington software firm, has filed a complaint against the principals Southboro-based BIQ LLC for copyright infringement, theft, and unauthorized disclosure of trade secrets, breach of contract, and unfair and deceptive acts.
The complaint, filed in U.S. District Court of Massachusetts on December 4, calls for an injunction to stop BIQ LLC from marketing and selling its spend analysis solution, claiming that it was developed from Emptoris intellectual property and trade secrets.
BIQ LLC's president and CEO, Eric Strovink, and Matthew Paulson, vice president of engineering for BIQ LLC, are both former employees of Zeborg Inc., a New York-based company acquired by Emptoris in August of 2003. Emptoris alleges that Strovink and Paulson used trade secrets and copyrighted technology from the company to develop BIQ's spend analysis software product.
Emptoris' complain further alleges that the intelligence used to develop the software, as well as extensive design elements, are identical to those originally used by Zorborg. The Burlington company said it will pursue all legal means available, and is confident of a favorable outcome.
