The Beverly Hills-based Schall Law Firm on Monday announced it is filing a class action lawsuit against Marlborough medical device manufacturer Boston Scientific, alleging potential Securities Exchange Act violations, according to a press release from the lawyers.
According to the announcement, class members are accusing Boston Scientific of overstating in public statements the continued profitability of its LOTUS Edge Aortic Valve System, despite the product suffering from a dysfunctional delivery system. Lawyers allege Boston Scientific made false and materially misleading statements, causing investors who purchased securities between April 24, 2019 and Nov. 16, 2020 to incur damages.
"We dispute these allegations and will vigorously defend the company against this lawsuit," said Kate Haranis, Boston Scientific's senior manager for corporate PR, in an emailed statement.
The class has not yet been certified, according to Monday’s press release
Schall is joined by others, including Glancy Prongay & Murray LLP of New York, The Law Offices of Frank R. Cruz of Los Angeles, Rosen Law Firm of New York and Pomerantz LLP, also of New York.
