The U.S. International Trade Commission has issued a limited exclusion order prohibiting the importation of aerogel insulation manufactured by two Chinese companies alleged to have infringed upon patents held by Northborough-based Aspen Aerogels.
The ruling, issued Monday, prohibits Guandong Alison Hi-Tech Co. and Nano Tech Co. from importing aerogel insulation Aspen claims infringes on its own product.
The ITC’s final ruling found the companies did infringe on the patents held by Aspen.
Monday’s ruling marks another win in this case for Aspen. Last month, a German court issued a series of judgements prohibiting a Dutch company from reselling aerogel blankets manufactured by Alison Hi-Tech Co.
The investigation began in June 2016 after Aspen filed a complaint.
The order will be enforced by the U.S. Customs and Border Protection after a 60-day presidential review. The final ruling can be appealed to the U.S. Court of Appeals.
"The ITC final determination and our recent win in Germany serve to validate the strength of the patent portfolio protecting our innovative aerogel technology platform,” said Aspen President and CEO Don Young. “We remain firmly committed to defending our intellectual property and will continue to aggressively assert our patents against any company that who infringes our patented technology.”
