Aspen Aerogels, a Northborough manufacturer of aerogel insulation for the energy infrastructure and building materials markets, announced Tuesday a series of judgments from a German court against a Dutch reseller of an aerogel product for which Aspen claims it holds patents.
The Mannheim Regional Court in Germany issued the judgments Tuesday to prohibit Hiltex Technice Weefsells from selling aerogel blankets manufactured by China-based Alison Hi-Tech Co.
Citing the court ruling the court, Aspen said Hiltex is ordered to refrain from supplying the Chinese aerogel products in Germany and is liable for damages.
Aspen and Hiltex reached an agreement to prevent Hiltex from reselling the product in any European country in which the patents are maintained.
Aspen’s litigation against Alison and Nano Tech Co. -- another Chinese company -- alleges patent infringement is ongoing, the company said.
An administrative law judge of the U.S. International Trade Commission said in October that Alison and Nano infringed on Aspen’s patents.
"Our recent wins both in Germany and in the initial determination at the International Trade Commission serve to validate the strength of the patent portfolio protecting our aerogel technology platform,” said Don Young, president and CEO of Aspen Aerogels. “From the outset, we have maintained our firm belief that the sale, resale or use of Chinese aerogel products infringe our patents.”
