Northborough manufacturer Aspen Aerogels said Wednesday it has won its patent infringement lawsuits in a German court against Chinese companies.
The Manheim Court said last week that Gaungdong Alison Hi-Tech Co. and Nano Tech Co. infringed on one of Aspen’s European patents in Germany by selling aerogel insulation products for which Aspen holds a patent.
The court issued injunctions prohibiting the offer, distribution, use or import of those infringing products. Both Chinese companies are held liable for Aspens’ court costs and legal expenses.
The ruling is subject to an appeal to the Higher Regional Court of Karlsruhe.
The German patent court has deemed Apsen’s patent to be valid after Nano Tech Co. attempted to nullify the document.
The German ruling comes about a year after the company won its patent case at the U.S. International Trade Commission against the same companies.
"These decisions also serve as clear notice to all companies that intend to purchase, import, use or resell infringing products that such actions are, simply put, illegal,” President and CEO Don Young said in a statement. “We remain firmly committed to enforcing our intellectual property and recovering all compensation available to us under the law.”
