Acton builder fined in petrol spill

Empyrean International LLC of Acton must pay a $10,000 fine for spilling fuel into its own drinking water well and failing to tell the Massachusetts Department of Environmental Protection about it.

The fine stems from cleanup of contamination at the company's headquarters. In 2003, Empyrean submitted a clean-up report regarding its site to DEP, but the report "failed to consider the on-site drinking water supply well as an exposure point," DEP said.

Sure enough, the water was contaminated, but Empyrean didn't notify DEP of the contamination within 72 hours as required by law, and chose the wrong way of cleaning it up, according to the DEP.

The well has since been disconnected.
