Hammer accident leads to P&W complaint

A Leicester man who claims he was struck in the face by a hammer while working in the Providence & Worcester Railroad ‘s Worcester engine house has filed a complaint against the company in federal District Court.

Dennis J. Madore filed a complaint against the railroad under the federal Employers’ Liability Act Tuesday. He claims that on Dec. 10, 2004, he was struck in the face by a hammer as a “result of the negligence of the defendant, its agents, servants or employees,” and their failure to provide a safe place to work.

Madore claims he’s been disabled since the accident, resulting in lost wages and mounting doctor’s bills. He claims he “will continue to be incapacitated in the future.”

Madore is demanding that the case be heard by a jury.

P&W spokesmen could not be reached for comment this morning.
